SMS & TCPA Disclosure
Last updated: September 12, 2026
MergeCast powers text-message programs for businesses that send personalized video messages to their own contacts. This disclosure explains how those SMS programs work and your options. It supplements our Terms of Service and Privacy Policy.
1. Program description and consent
Messages are consent-gated. A business may only text you after you have given express opt-in consent — for example, by providing your mobile number and agreeing to receive texts. Your opt-in is confirmed by replying YES to a single confirmation text, and no other message is sent until you do. Each opt-in is documented with its timestamp, method, source, and IP address. Businesses register their sending numbers under 10DLC through our messaging provider, Twilio, so their identity is associated with the program.
2. How consent is collected
Consent is collected one to one. A representative of the sending business speaks with the customer by phone, in person, or in an existing email thread; if the customer asks to be sent a video, the representative reads the call to action below, enters the mobile number, and ticks a separate consent box that is unchecked by default. The customer’s own handset then confirms it, so every opt-in is a double opt-in. Consent is optional — it is never a condition of any purchase and never a condition of using the product — and it is never bundled with another agreement. Nothing is sent on the representative’s record alone except the single confirmation request below.
What the representative says. The call to action, word for word:
I can text you the video from MergeCast. Message frequency varies. Message and data rates may apply. Reply HELP for help and STOP to opt out at any time. Our privacy policy is at merge-cast.com/privacy and terms at merge-cast.com/terms. May I text you at this number?
What the representative sees. The consent box is separate from the mobile number field, optional, and unchecked by default; the representative ticks it only after the customer agrees, and the application records the consent with its method, source and timestamp.

What the customer receives. One confirmation request, sent from the registered number:
[Rep Name] at MergeCast would like to text you a video. Reply YES to confirm. Msg & data rates may apply; msg frequency varies. Reply HELP for help. https://merge-cast.com/sms-policy MergeCast: Reply STOP to opt out
Nothing further is sent unless the customer replies YES from that handset. When they do, the application replies:
You're confirmed. [Rep Name]'s video is on its way. Reply HELP for help. MergeCast: Reply STOP to opt out
and only then releases the video message.
Message frequency varies. Message and data rates may apply. Reply HELP for help and STOP to opt out at any time. Our Privacy Policy and Terms of Service apply.
3. Message frequency
Message frequency varies based on how the sending business uses the program and your interactions with them. There is no fixed number of messages.
4. Costs
Message and data rates may apply. MergeCast and the sending business do not charge you for receiving texts, but your mobile carrier’s standard rates apply based on your plan.
5. Opting out, help, and re-subscribing
- STOP — reply STOP to any message to cancel. You will receive one confirmation and then no further messages from that program.
- START — reply START to opt back in after opting out.
- HELP — reply HELP to receive help information and support contact details.
Opt-out requests are honored promptly — the number is suppressed in under a minute, and no further messages are sent unless you opt in again.
6. Carrier liability
Carriers are not liable for any delayed or undelivered messages. Message delivery is best-effort and depends on your carrier and device.
7. Supported carriers
Text messages are delivered through Twilio to all major U.S. carriers (including AT&T, T-Mobile, Verizon and their affiliates).
8. Privacy
Information collected through SMS is handled as described in our Privacy Policy. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.
